Why Do Car Accidents Happen in Missouri?

The Show-Me State is known for its particularly deadly car accidents, as are its bordering states.

What’s the deal?

Here are a few reasons that car crashes hit the area so hard:

  • The consumption of alcohol is deeply integrated into Missouri culture. Additionally, underage drinking is poorly regulated.
  • Missouri gets all four seasons. It’s raining one day with a tornado the next. It’s not great for driving.
  • Highways are common and necessary when commuting. It’s here that accidents are most likely to happen.
  • Cities like St. Louis and Kansas City are densely populated. Not much good can come from cramming a bunch of people together on the freeway.
  • Missouri is like a “middle-man” state. A lot of people drive through Missouri en route to a different state. The time they spend in Missouri is almost entirely on highways, especially 64, 270, 44, 70, and 55.
  • Drivers think it’ll never happen to them. And they don’t know just how much a Missouri car accident lawyer can help!

What Are The Car Laws in Missouri?

The only thing worse than breaking your bones is breaking the law.

The problem is you may be breaking the law without even knowing it.

Simply driving your vehicle without meeting your city or state’s automotive standards is illegal.

These are some Missouri car laws you should know (from the Missouri Attorney General):

  • Vehicles registered in St. Louis and four counties require an emission inspection as well as a safety inspection. These counties are St. Louis, St. Charles, Franklin, and Jefferson.
  • The Missouri New Vehicles Warranty Law, commonly called the “Lemon Law,” protects buyers of new vehicles by enforcing the manufacturer’s express warranty. The Lemon Law does not apply to used cars.
  • In most cases, if a vehicle’s title is not properly transferred at the time of purchase, the sale is void.
  • If you are the winning bidder [of an online auction], you’re obligated to buy the car, even if you haven’t seen it.
  • Missouri law requires that a dealer or an individual selling a used car must reveal to a potential buyer the total number of miles registered on the odometer and any alteration done to the odometer. If the odometer has been changed, state law requires notice with details of the change posted on the inside left door frame.
  • Odometer fraud is a crime, and you may be entitled to remedies in court. If you believe you have been defrauded by an odometer rollback, you may sue in federal court under the federal Motor Vehicle Information and Cost Savings Act or in state court. A Missouri car accident lawyer in your county is fundamental to this process.
  • In Missouri, state consumer laws prohibit unfair and deceptive practices in auto repair. Mechanics who mislead, deceive, or make misrepresentations to consumers may be subject to penalties under the Merchandising Practices Act found in Chapter 407 of the Missouri Revised Statutes.

Is It Worth Calling An Attorney?

If you’ve been involved in a car accident, it’s likely you’ve struggled to feel like everything is back to normal.

Whether it’s been the emotional, physical, or financial toll, it’s possible for you to receive money for the suffering you’ve endured.

The only catch is you have to do this through the court system. Scared? Don’t be. A lawyer will lead the way.

Personal injury attorneys help their clients in a variety of ways.

Here’s an overview of what your lawyer will do for you:

  • First, they’ll speak to you about your situation. Not all cases are suited to go to court. If they think they could build a strong case specifically for your circumstances, they’ll take you on as a client.
  • They’ll gather evidence. Personal injury suits, including wrongful death suits, require substantial evidence in court. The evidence paints a picture for the jury and will largely affect the outcome of the trial.
  • Your attorney will assess damages. By looking at the evidence, they’ll analyze exactly how much you’re owed for the accident and its aftermath.
  • At any point in the civil lawsuit process, your lawyer might work out a settlement with the defendant. If a settlement remains absent for long enough, the case will go to trial. The court will then hear your case and make their own assessment about who is liable for the accident. Damages can be compensatory or punitive.
  • In the best-case scenario, you will win the case and receive compensation. You can’t always predict how the judgment will result, but your attorney should be closely guiding you so that there are no surprises.
  • Always call a Missouri car accident lawyer after an accident, even if you aren’t sure who’s fault it was.
