September 2nd, 2026: Senators Urge Court to Block Roblox, Discord From Forcing Sex Abuse Suit Into Arbitration

Three U.S. senators filed an amicus brief urging a California appeals court to reject Roblox and Discord’s bid to force a teen’s sex abuse suit into arbitration.

The teen alleges Roblox misrepresented its platform’s safety and enabled a predator to identify, groom, and directly communicate with him, and that Discord similarly ignored predators operating on its platform.

A trial court had already ruled the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act applies to the case.

The senators argued Congress intended that law to apply broadly to any sexual assault or harassment claim, not just cases where a company’s own employees committed the abuse.

They wrote that limiting the law’s scope would allow companies to use arbitration clauses to shield themselves from public accountability, the exact outcome Congress sought to prevent.

Discord said it uses technology and trained safety teams to proactively detect and remove violating content.

Roblox faces similar arbitration disputes across its broader multidistrict litigation and has indicated it plans to compel arbitration in many of those cases too.

August 3rd, 2026: Discord Agrees to Strengthen Safety Features for Texas Teens

Discord agreed to a temporary injunction resolving Texas’s request for preliminary relief in its ongoing lawsuit against the company, without admitting to violating the law or engaging in any wrongdoing.

The agreement resolves the preliminary phase of Texas Attorney General Ken Paxton’s case, while the broader underlying lawsuit continues in court.

Under the terms, Discord committed to implementing stronger default safety settings for teen accounts belonging to Texas users going forward.

The case remains pending as State of Texas v. Discord Inc. in the 199th District Court of Collin County, Texas, with the state continuing to press its broader claims that the company’s original practices exposed children to predators while misleading parents about the platform’s safety.

July 24th, 2026: Texas Wins Temporary Injunction Forcing Discord Safety Changes

A Texas court granted the state’s request for a temporary injunction against Discord following a two-day evidentiary hearing in which four Texas parents testified about what their children experienced on the platform.

One parent described abuse her child suffered at the hands of a man who is now serving a life sentence in federal prison after being convicted in connection with the case.

The injunction requires Discord to immediately extend stronger age-assurance measures and safer default account settings to Texas children, rather than waiting for the broader litigation to reach a final resolution.

Testimony at the hearing reportedly revealed that Discord had announced plans in February 2026 to roll out these same protections worldwide, including in the United States, before quietly delaying the U.S. rollout while still meeting its committed deadline for users in Britain.

By the time of this ruling, Texas had been joined by New Jersey, Nevada, Indiana, and Arkansas in pursuing legal action against Discord.

May 29th, 2026: Texas Secures Emergency Restraining Order Against Discord

Texas obtained an emergency temporary restraining order against Discord the same day the state’s underlying lawsuit was filed, forcing the company to make immediate changes to how it handles young users’ accounts.

The order required Discord to stop automatically defaulting Texas children’s accounts to the platform’s weakest available safety settings and barred the company from continuing to market itself to parents as “safe by design” while those defaults remained active.

The state’s court filing detailed the toll of Discord’s alleged safety failures, citing a case in which a 13-year-old Texas girl was allegedly groomed on the platform before being sexually assaulted in her own home.

Attorney General Paxton framed the company’s conduct in stark terms, arguing Discord had been warned repeatedly and chose inaction rather than fixing the underlying safety gaps.

A hearing on whether to extend the order into a longer-term injunction was scheduled for June 5, 2026.

May 22nd, 2026: Texas Sues Discord Over Child Predator Exposure

Texas Attorney General Ken Paxton sued Discord, accusing the company of exposing children to predators on its platform while deceiving the public about how safe it actually was.

The lawsuit followed a case out of Galveston County, where a family alleged their 13-year-old daughter was sexually assaulted by someone she had met and interacted with through Discord.

Paxton’s office originally opened an investigation into Discord in 2024, alongside several other tech companies, with that earlier inquiry focused primarily on user data privacy practices rather than specifically on child safety.

By the time Texas filed suit, the state joined New Jersey, Nevada, and Indiana as the fourth state to actively pursue legal action against Discord, part of a wider pattern of state attorneys general turning their attention to the platform’s handling of child safety.

May 5th, 2026: Nevada AG Sues Discord for Failing to Protect Children

Nevada Attorney General Aaron Ford announced a lawsuit against Discord, alleging the platform’s core design choices placed young users in serious danger while the company failed to adequately explain those risks to parents.

The suit followed a state investigation that found Discord lacks meaningful age verification for new accounts, takes a largely hands-off approach to moderating content and banning abusive accounts, and does little to limit direct interactions between children and unknown adults.

Ford’s office argued that the combination of design choices effectively made Discord a preferred platform for individuals seeking to target children online, and that the company’s public safety messaging did not reflect those underlying risks.

April 17th, 2025: New Jersey AG Sues Discord Over Deceptive Child Safety Claims

New Jersey Attorney General Matthew Platkin filed suit against Discord through the state’s Division of Consumer Affairs, alleging the messaging platform engaged in deceptive and unconscionable business practices that misled parents about the actual effectiveness of its safety controls.

The lawsuit, one of the earliest state actions of its kind against Discord, alleges the company’s public safety claims obscured just how easily children using the platform could be exposed to child predators, along with violent and sexually explicit content, through direct messages and shared servers.

The suit, which follows an investigation led by New Jersey’s Division of Consumer Affairs, seeks a court order barring Discord from continuing the alleged violations of the state’s Consumer Fraud Act, along with civil penalties and disgorgement of any profits the company generated in New Jersey from the conduct at issue.

These cases have alleged that lax oversight, private communication features, and inadequate safeguards allowed abusive conduct to continue without timely intervention.

Plaintiffs have also challenged whether Discord used proper age verification or took sufficient steps to prevent adults from contacting and exploiting minors.

Direct Discord cases have included allegations involving organized exploitation networks, severe emotional harm, sexual abuse, coercion, and wrongful death.

Discord forwarded 489,782 reports involving suspected online child exploitation to the National Center for Missing & Exploited Children’s CyberTipline in 2025, according to information released by the U.S. Senate Judiciary Committee.

The total is equivalent to more than 1,300 reports per day, although a CyberTipline report does not necessarily represent a unique victim, offender, or confirmed instance of abuse.

Federal oversight also identified concerns with some Discord reports that lacked sufficient account or location information, while Discord has since reported changes intended to improve its detection and reporting processes.

The volume of suspected child exploitation reports, combined with allegations raised in civil lawsuits and government actions, has increased scrutiny of whether Discord’s safety systems adequately protected minors from foreseeable abuse.

Discord, 764, and Online Child Exploitation Networks

Federal investigations and criminal cases have identified Discord as one of the online platforms used by members of 764, CVLT, Greggy’s Cult, and related exploitation networks to target and communicate with minors.

The FBI describes 764 and similar groups as violent online networks that use manipulation, threats, and blackmail to coerce children into producing sexually explicit material, engaging in self-harm, or performing other degrading acts.

Federal prosecutors have also charged members of CVLT with operating an organized child exploitation enterprise that targeted vulnerable children and coerced them into producing child sexual abuse material.

In December 2025, federal prosecutors charged five alleged leaders of Greggy’s Cult, stating that the group operated through a series of Discord servers where members allegedly directed minors to engage in sexually explicit and degrading conduct during video calls.

Prosecutors further stated that Greggy’s Cult predated 764 and that prominent members of 764 and similar networks had also participated in Greggy’s Cult.

Other federal cases have documented individuals associated with 764 and CVLT allegedly using Discord to groom minors, obtain explicit material, threaten to distribute images, and coerce victims into self-harm.

These cases have increased scrutiny of whether Discord’s safety systems were sufficient to identify and disrupt organized groups that repeatedly used the platform to exploit children.

State Lawsuits and Investigations Against Discord

State attorneys general have increasingly challenged Discord’s child-safety practices through lawsuits and investigations focused on how the platform is designed and marketed to families.

The cases generally allege that Discord failed to adequately restrict communications between adults and minors, relied on inadequate age verification practices, and exposed children to sexual or otherwise harmful content.

Several states also accuse Discord of deceptive marketing practices regarding safety features that were presented to parents and users as protective.

New Jersey became one of the first states to bring a major enforcement action against Discord in 2025 following a multiyear investigation into the platform’s safety controls and representations.

Additional lawsuits followed in 2026 as attorneys general in Nevada, Indiana, Texas, and Arkansas challenged Discord’s practices under state consumer protection laws.

The complaint followed the death of a 17-year-old Indiana girl and cited concerns about how online platforms can expose minors to adults who target children, although the complaint states that the girl’s initial contact with the adult involved Roblox.
  • Texas: Attorney General Ken Paxton sued Discord on May 22, 2026, alleging the company exposed children to predators while misleading parents about the platform’s safety. Texas first obtained a temporary restraining order and later secured an agreed temporary injunction requiring stronger age-assurance measures, safer default settings, restrictions on stranger communications, and additional protections for minors.
  • Arkansas: Arkansas Attorney General Tim Griffin sued Roblox and Discord in June 2026, alleging that the companies knowingly profited from platforms that placed children at risk and failed to provide adequate protections against sexual exploitation and other harmful conduct.

Brazilian regulators separately ordered Discord to suspend live-streaming functionality in the country until the company could demonstrate adequate measures to address serious risks to children and adolescents.

The U.S. and international actions do not establish liability in individual sexual abuse cases, but they provide additional scrutiny of Discord’s age controls, safety representations, platform design, and response to known risks involving minors.

What Did Discord Know About Child Exploitation Risks?

Discord has faced growing legal and regulatory scrutiny over whether the company knew that young people could be exposed to grooming, inappropriate sexual conduct, and other forms of exploitation through its platform.

By 2025, Discord was reporting a substantial volume of suspected abuse to the National Center for Missing and Exploited Children, indicating that child exploitation was a significant and recurring safety issue on the service.

Discord submitted 489,782 reports involving suspected online child exploitation to NCMEC’s CyberTipline in 2025, equivalent to more than 1,300 reports per day.

Federal oversight records also show that NCMEC communicated frequently with Discord throughout 2025 about problems with its CyberTipline reporting, including missing account or location information and reports containing material unrelated to child sexual exploitation.

NCMEC raised some of these concerns through biweekly meetings, multiple emails, and a formal escalated written complaint to Discord.

Separately, NCMEC has identified Discord as one of the publicly available platforms used by violent online groups such as 764 to target and manipulate children.

Lawsuits and state enforcement actions now argue that this history is relevant to whether Discord knew about risks to minors while maintaining platform features that allegedly allowed adults to communicate privately with children.

Discord faces major legal challenges concerning child online safety and alleged platform design defects, although the company disputes claims that its systems failed to adequately protect minors and has continued introducing new safety and age-assurance measures.

Discord's Child Safety Features and 2026 Changes

Discord announced substantial changes to its child-safety systems in 2026 as lawsuits, regulatory actions, and public scrutiny increased around the platform’s protections for minors.

The company introduced a “teen-by-default” model intended to apply stronger safety settings unless a user is confirmed to be an adult.

Discord also expanded its age-assurance program, although the broader global rollout was delayed until the second half of 2026 while the company added verification options and increased transparency about third-party vendors.

  • Privacy safeguards: Discord states that facial age estimation can occur on-device, identification documents are used to determine age and then deleted, and Discord receives an age result rather than the user’s identity.

How Is Discord Involved in the Roblox Sexual Abuse Litigation?

Discord is named alongside Roblox in a number of lawsuits alleging that child predators used both platforms as part of an escalating grooming process.

The federal Roblox multidistrict litigation describes claims in which predators allegedly made initial contact with minors on Roblox before persuading them to continue communicating through Discord, Snapchat, Instagram, or other social media platforms.

Plaintiffs allege that moving conversations to Discord gave predators access to more private communication features that could be used to deepen relationships with children and introduce sexual topics.

Lawsuits have characterized this pattern as a potential “grooming pipeline,” in which predators use gaming platforms to identify young users before transitioning them to services where communication may be less visible to parents or moderators.
