Intro to the Tylenol Autism Lawsuits

Tylenol is one of the most popular over-the-counter pain medications in the world, found in almost every pharmacy and grocery store.

Recent scientific evidence has found that prenatal acetaminophen exposure may be linked to an increased risk for children to develop autism spectrum disorder (ASD), attention deficit hyperactivity disorder (ADHD), and other developmental disorders.

Tylenol Autism Lawsuits are being filed against manufacturers of generic acetaminophen, and are being consolidated into multidistrict litigation (MDL).

Our Illinois Tylenol Autism Lawyers are here to help you through the legal process and help you seek justice.

No, there is not a Tylenol Class Action Lawsuit, Tylenol Autism Class Action Lawsuit, or any other form of class action lawsuit for the increased risk of autism spectrum disorders and other developmental disorders related to Tylenol usage during pregnancy and its potential effects.

Tylenol Autism Lawsuits are consolidated into multidistrict litigation (MDL).

Class action lawsuits are different from MDL.

MDL is a special federal legal procedure designed to speed the process of handling complex litigations by consolidating cases and addressing all pretrial procedures in one court.

When a large number of people who have all been affected by the same thing file individual lawsuits, the federal court system allows for the consolidation of these cases into an MDL to make them easier to manage.

MDLs take cases from multiple federal districts (each state has at least one district), and puts them into one district court.

This single district court, and one judge, then address all the discovery and pretrial procedures that apply to every case – cutting the costs and amount of resources needed, and keeping court rulings consistent with similar cases.

Settlement amounts for Tylenol Autism Lawsuits are still to be determined.

The Tylenol Litigation is still in its early stages, and our lawyers are reviewing Tylenol Autism Lawsuits daily to help people get on the right track.

Our lawyers estimate that Tylenol Autism Lawsuit settlements could be between $50,000 and $500,000+ depending on the facts of an individual case and the direction of the Tylenol Litigation.

These estimates are only projections based on prior results in dangerous drug lawsuits. These estimated settlement amounts are not guarantees.

The lawsuits consolidated in multidistrict litigation named drug manufacturers of generic acetaminophen as defendants.

These companies include:

  • Costco Wholesale Corp
  • Walmart Inc.
  • CVS Pharmacy Inc.
  • Rite Aid Corp
  • Safeway Inc.
  • Target Corp
  • Walgreens Boot Alliance Inc.

Settlements for mothers who took Tylenol and whose children were subsequently diagnosed with Autism Spectrum Disorder (ASD), Attention Deficit Hyperactivity Disorder (ADHD), or other developmental disorders will depend on a number of factors.

Factors that can impact Tylenol Autism Lawsuit settlement amounts include quality of evidence, severity of diagnoses, damages claimed, and more.

Tylenol/Acetaminophen Autism ADHD Lawsuits are consolidated in multidistrict litigation.

Multidistrict litigation is a special federal legal procedure used to speed up the process of lawsuits filed by people impacted by the same product or similar injuries.

There is NOT a Tylenol Autism Class Action Lawsuit for autism and ADHD diagnoses.

Many law firms are referring to the Tylenol MDL as the “Tylenol Class Action Lawsuit” or “Tylenol Class Action Lawsuit MDL”, but these terms are incorrect.

Multidistrict litigation is different from class action lawsuits.

Class action lawsuits divide a settlement evenly amongst all plaintiffs.

Multidistrict litigation on the other hand would divide a settlement between plaintiffs based on the merit and facts of their individual cases.

Previous research and previous studies have widely reported that Tylenol is safe for pregnant women to use, and many health professionals still may suggest it.

Though acetaminophen relieves pain and fever, new research and warnings from doctors and scientists indicate that there may be a possible link between using Tylenol during pregnancy and a greater risk for neurological disorders that hamper fetal brain development.

Recent scientific evidence has found that prenatal exposure to acetaminophen may increase the risk of Autism Spectrum Disorders, Attention Deficit Hyperactivity Disorder (ADHD), and other developmental disorders.

An Overview of the Tylenol Lawsuits

Since 2022, mothers of children with ASD and ADHD have been filing lawsuits against the makers and distributors of generic acetaminophen.

These companies are facing claims for allegedly placing children at risk for developing ASD and ADHD from their generic acetaminophen products, based on scientific evidence that has linked the pain reliever to an increased risk for autism spectrum disorder and attention deficit hyperactivity disorder.

These companies are potentially liable for prenatal acetaminophen exposure for two reasons:

  1. These companies are alleged to have failed to warn users of the risks of using their generic acetaminophen products. More specifically, the generic acetaminophen sold and distributed by these distributors and makers doesn’t come with a warning of ASD or ADHD-related risks.
  2. The lack of warnings may imply that the companies either didn’t know about the risks of their products or knew about the risks but chose to distribute their acetaminophen anyway.

Either way, the companies involved in the lawsuits may be liable for placing the public at risk.

With a significant amount of claims already filed, the Tylenol autism lawsuits were consolidated into a multidistrict litigation in 2022.

Known as the “Acetaminophen – ASD-ADHD Products Liability Litigation,” the MDL was filed on October 5, 2022, in the Southern District of New York Court.

Southern District of New York Judge Denise Cote oversees the case, and the defendants include the following generic acetaminophen makers and distributors:

  • Walgrees
  • CVS
  • Walmart
  • Costco
  • Rite-Aid
  • Safeway
  • Target
  • Johnson and Johnson
  • Other manufacturers

You still have time, and we are accepting more cases.

Our experienced personal injury and product liability attorneys are also reviewing and investigating legal actions against the companies mentioned.

Recent Developments in the Tylenol Autism Lawsuits

Multiple manufacturers have attempted to file a motion to dismiss the Tylenol Autism claims, but Tylenol Autism MDL Judge Denise Cote has not allowed any such motions to go forward.

Recently, Kenvue Inc. (formerly J&J’s consumer health unit) was told by Judge Cote that the company cannot immediately appeal the order allowing Tylenol Autism Lawsuits to move forward.

Tylenol Autism MDL Judge Cote denied Kenvue’s motion to dismiss in April.

In the meantime, other plaintiffs have started filing lawsuits against store-brand Tylenol makers, including Walmart.

Walmart’s Equate acetaminophen has been available for years without any warning about the risk of autism in newborns, placing many pregnant women and their children at risk.

Scientific Evidence Linking Tylenol and Autism Spectrum Disorder

Various studies are suggesting the correlation between prenatal exposure to Acetaminophen and a child’s risk of developing ADHD and ASD

In 2016, one study looked into whether or not children can develop ASD or ADHD from prenatal acetaminophen exposure.

The researchers found that exposure to acetaminophen in utero led to ASD symptoms, particularly among boys.

One study funded by the National Institutes of Health in 2019 highlighted the correlation between ASD and ADHD in children and exposure to acetaminophen in utero.

In the 2019 study, researchers examined nearly 1,000 umbilical cord samples from delivered children to detect traces of acetaminophen.

To detect the effects of high acetaminophen, the researchers did regular follow-ups on the children.

After eight years, the researchers discovered that nearly 30% had developed ADHD.

This 2019 study isn’t the only one that suggests the link between acetaminophen and ASD and ADHD.

2021 meta-analysis uncovered a higher incidence of ADHD and ASD in children with prenatal Tylenol exposure.

There was also a higher incidence of ADHD and ASD among boys.

Another 2021 study echoed the findings of previous research but added a precautionary call to action for more research and better awareness generation of acetaminophen’s risks.

In the study entitled “Paracetamol use during pregnancy — a call for precautionary action,” the researchers called for more public warnings about acetaminophen use during pregnancy and the development of an ASD or ADHD diagnosis.

These studies shed light on the potential issue at hand, and more evidence of the connection between prenatal exposure to acetaminophen and developmental disorders like ADHD and ASD continues to surface.
